The Federal Government’s Mandatory Code of Conduct for Commercial Tenancies sets the tone, with specific requirements and support rolled out by each State and Territory, with the long awaited Code for Western Australia released on 29 May 2020.

The Code is intended to be a “roadmap” for how landlords and tenants can work through their leasing relationships during the pandemic and provide clarity as to the way forward. However, as with most legislation or regulations the devil is in the detail.
